We at McLennan Adam Davis, solicitors, encourage clients to leave Wills, but it is interesting that in general individuals dying without leaving a Will of any description outnumber individuals who die leaving a Will. It is estimated that 53% of the UK population do not have a Will.
The majority of people would still use a solicitor to write a Will, however online Will services are becoming more popular.
Cohabiting couples – the majority of these individuals do not have a Will, which at the present moment can be quite detrimental as the surviving co-habitant would have no automatic right to inherit.
A number of individuals who have Wills with young children do not stipulate within their Wills Guardians o look after their children if they were to pass away before their children attain the age of majority.
Wills need to be reviewed on a regular basis. When did you last review your Will. Was it within the last three years, or have you never reviewed your Will. Have there been any change in circumstances where you should consider reviewing your Will, i.e. children / grandchildren / divorce etc.
A number of people perhaps feel they are too young at this moment in time to leave a Will, but when or at what age do you consider that you are old enough to leave a Will?
Within your Will you can leave items of jewellery and items of sentimental value to stipulated beneficiaries and this is a valid reason, if any, for leaving your wishes expressed within a Will.
If your Will is not with your solicitor do your family know where the Will can be found in order for it to be executed properly.
Whilst you are arranging your affairs to be in order with regard to a Will you should also consider, as equally important a document, a Power of Attorney and have you considered a Living Will, or an Advanced Medical Directive as it is sometimes referred to.
